Questions regarding ESA to UC managed migration. was created by sn5775
Hi,
I am a long-term claimant of Income-related Employment and Support Allowance (support group) and have recently been subject to managed migration on to Universal Credit.
I also currently claim Personal Independence Payment (daily living component standard £314.82 per month).
Both the Turn2Us and entitled.to calculators estimated that I should receive £809.64 in Universal Credit (£393.45 personal allowance and £416.19 limited capability for work and work-related activity.
I have recently received my first statement from Universal Credit but I have some concerns.
The standard allowance and limited capability entitlements are as expected, but I have been given transitional protection which I didn't expect as my total UC entitlement (£890.64) is more than my monthly equivalent Employment and Support Allowance (£689.22). I have been given £336.53 in transitional protection. Therefore my total UC entitlement before deductions is £1,146.17.
On my first UC statement it then states under deductions "as this is an average of other benefits that you're continuing to claim" and a deduction from my total UC entitlement of £456.95 and a total payment for this month of £689.22, which is £120.42 less than I expected.
I checked my UC journal online and there are two entries that state "Other benefits affecting your Universal Credit" and "Our records show that you are getting Incapacity Benefit."
I am confused and concerned by this because I don't claim Incapacity Benefit. I think I may have claimed IB for a relatively short period of time when my main illness first started, which was back in 2002, but as far as I can remember at some point I was migrated on to Employment and Support Allowance which I have received ever since.
Please accept my apologies if I have gone wrong somewhere with my understanding of the situation.
I would be most grateful for any support and advice that you are able to offer. If you have any questions please let me know.
Kind regards,
Steve.

Hi sn5775
Have you had a look underneath where it says "as this is an average of other benefits that you're continuing to claim".
I expect it will say Employment and Support Allowance ?

Thank you for your reply. The exact wording of my first UC statement is as follows:
What we take off (deductions)
Other benefits
We take money off your payment
As this is an average of other benefits that you're continuing to claim
Incapacity Benefit -£456.95
Total deductions -£456.95
Your total payment for this month is £689.22
Regards,
Steve.

Hi sn5775
It is as I thought Contributions Based ESA which is known as New Style ESA after Managed Migration. It just shows how uneducated about Benefits some people must be to refer to it as Incapacity Benefit which was abolished 10 years ago.
It is correct that this is deducted £ for £ from UC. It happens to everyone.

Thank you for your reply.
I telephoned the Universal Credit helpline who informed me that they had been advised that I was claiming Incapacity Benefit and they advised me to contact the Incapacity Benefit department to request that they update their records. They also asked me to add a note on my Universal Credit journal stating that I don't receive Incapacity Benefit and I haven't since approximately 2009.
I then telephoned the Incapacity Benefit department who advised me that there was an old Incapacity Benefit claim still showing on their system, which didn't have an end date (which was causing the problem) or payment associated to it.
They advised me that they would update their records and send a message to the Universal Credit department to advise them accordingly.
Am I correct in thinking that I only received the transitional protection payment due to the Incapacity Benefit error as my estimated Universal Credit (£809.64) is more than I used to receive in Employment and Support Allowance (£689.22)?
What happens next? Will I be asked to repay the transitional protection payment (£336.53) and I then receive the amount deducted due to the Incapacity Benefit error (£456.95)? Or will I just receive the difference between the two (£120.42)?
I am worried about spending any of the payment in case any of it needs to be repaid.
Thank you again for your kind assistance.

Hi sn5775
Incapacity Benefit was a contributions based Benefit and you would have been transferred to Contributions Based ESA. Conts Based ESA is not included in the Migration calculations, so the amount does not affect Transitional Protection.
You will need to check your new UC statement when it has been amended on your account.
