I am going to tribunal and am going through my recording of my pip interview. I noticed that the assessor kept asking me to consider what I could do if I didn’t have my physical condition. This was particularly in the section about planning unfamiliar journeys. Is this considered an acceptable form of questioning?
I do not do unfamiliar journeys alone ever as I am terrified of falling and severely hurting myself and not being able to get up on my own, but he pressed me repeatedly on whether I could do such journeys if I didn’t have my physical disability. I eventually gave in unfortunately.

My latest MRI has shown that due to a fall earlier this year I have chipped some bone off a vertebrae leaving swelling (8months later), I have had deterioration in my spinal cord signal and partial transection of my spine. These seem to me to be serious consequences of my fall and would fully explain my extreme anxiety about going out alone to unfamiliar places, but my anxiety has not been accepted as overwhelming, therefore 0 points.

Can I argue about this successfully at tribunal?

Hi Margaret

I'm sorry you find yourself in this position.

I despair sometimes when I hear the type of questioning - it is not supposed to be a test. You do have a disability, and it's immaterial what you would do if you didn't have one. Hopefully, the Tribunal panel won't be so idiotic or try to trap you.

Your explanation for why you don't go out alone is valid - and that is what you should focus on in your appeal. I've noticed you mentioned unfamiliar journeys here. If you're afraid of falling, does that not apply when you make a familiar journey? After all there can be sudden hazards or changes to familiar journeys.
