New Style ESA was created by Anneb
My son, for whom I am Appointee, is on IR ESA and, I understand, Contributions Based ESA: recent telephone call with ESA advisor confirmed this as did follow up letter from ESA (my son had been on Incapacity Benefit and was moved to ESA Contributions Based in 2011 and a couple of years later got IR ESA too). Annual breakdown of his ESA never mentions Contribution based ESA, but his annual P60U for ESA has a huge amount that is taxable which works out at the annual Contributions Based ESA for that year. Son is in the LCWRA support group. I understand that when migrating over to UC from ESA that anyone who has part of their ESA as Contributions Based ESA will automatically get that changed to New Style ESA…and then I read that everyone moving to New Style ESA has to agree a claimant commitment ! My son would not be able to do that but I understand that if a claimant has an Appointee they shouldn't have to agree a claimant commitment. I can agree a claimant commitment but what kind of commitment is it ?

Hi Anneb,

You won't be asked to sign a Claimant Commitment. Here is the DWP guidance--
"Appointees will not be able to accept a Claimant’s Commitment on behalf of a claimant. If the claimant is physically or mentally unable to accept a Claimant’s Commitment and this is unlikely to change the requirement to accept a Claimant’s Commitment can be lifted."
