About 8 months ago I got awarded lower Daily Living PIP after a mandatory reconsideration. I think I should have got higher daily living and higher mobility but I was so overjoyed to get anything I never appealed it to tribunal. Is it too late? I've taken your test and you think I should get higher rate both and my line manager who is a welfare rights expert thinks I should get higher rate for both. What should I do?
You can still apply for a late appeal, though you will have to ask permission and provide a reason for not doing so before. For example, you can say that you didn't understand the whole system.
Be aware that the Tribunal will only judge the original decision. They will not take any notice of any deterioration in your health since then.
If your health has deteriorated in anyway - you can put in for a change of circumstances which will trigger a review and you can try for a better award. If you were given a better awarded it would be backdated to the time you inform them of the change.
Appeals in many areas of the country are taking about a year to be heard.
