Hi, I made the mistake of filling in my UC claim in the midst of a block of migraine without checking on here first and think I've made a mistake. I've been on WTC for years with the disability element. I'm self employed and made a small profit this year on tiny takings. I was treated successfully for cancer at the end of November 2023, have chronic migraine (15-25 attacks a month), anxiety and depression, Coeliac Disease, IBS/reflux and a nice bundle of other conditions. The migraine and depression impact my daily life considerably but I have been working 31-32 hours a week. When I filled in the claim form I ticked the limited capacity for work box because I'm only able to manage my condition by working at home and can work around it there. I thought there would be another place to explain why but there wasn't. I have explained I'm working full time and self employed.

DWP have now asked for a Fit Note so they can start the work capability assessment. I have filled in two journal entries asking when they want this dated from and until because the last time I had one was 14 years ago!

My dilemma is that I need my current income level to be protected and need to be continuing to work full time for that, but that I'm also stressed to high heaven and exhausted. I don't know how to proceed. What are the ramifications of taking the limited capacity for work route in terms of income and interactions with DWP, please? Also is there a way of contacting them given they seem not to be responding to my questions?

You may want to discuss your situation with your local Welfare Rights Organisation, they will be able to take all your circumstances into consideration; advicelocal.uk

In regards to your fit note, ask your Dr as to when they can date it from if your condition is ongoing see what your Dr can put down on the form, you will need to keep supplying fit notes until your work coach asks you to stop, make sure you record it on your journal.

For those self employed claimants applying for UC there are an assumed level of income using the minimum income floor, if you are placed in the LCW/LCWRA there is a work allowance, this is why you need to discuss your circumstances to your Welfare Rights Organisation, they can take it all into account when giving you advice.
