Social Security Scotland taking appeal to upper tribunal

I don't know all the details but today I heard of someone who had applied for Adult Disability Payment but been turned down. They appealed and a tribunal said they should receive full rate care and standard rate mobility. They were delighted. Now they have received notice that Social Security Scotland are taking it to an upper tribunal.

Is this normal?

Usual no, legal yes.

Both parties to a First Tier Tribunal, the claimant and the DWP, have the right to appeal to the Upper Tier Tribunal on an Error of Law in the making of the Decision, not because they disagree with that Decision.

The processes in Scotland are slightly different from England and Wales but achieve the same thing.
