DWP has missed the deadline for appeal response

Dear Moderator

Hello there, I hope you are well.

I was supposed to have received a response from the DWP to my lower tier PIP appeal by last Tuesday at the latest. I have heard nothing from the DWP at all. I phone HMCTS and a gentleman said that “the DWP is overwhelmed and very busy at the moment”. This provided me with no comfort and seems very vague and unhelpful.

What happens when the DWP fails to meet the required deadline in such cases? Will I,and all those in a similar situation, just be left in limbo for the foreseeable future?

Hi Porridge,

This actually happened to me back in June. The DWP had a deadline of 20th June 2023 to reply, and they failed. The result was they were given another month deadline to respond to July 20th 2023, in which they did. I would imagine your outcome will be the same.

Like me, you're likely to feel angered by it, because as a claimant, if you miss the deadline, I believe it's too late and your claim is scrapped, however don't quote me on this - I've never missed a deadline, just going on what I've read from previous correspondence.

They definitely have it. I've detailed the situation in the post about the CRMR1 form.

MR was requested in Feb, they sat on it. Finally found out they were refusing to do anything because CRMR1 form hadn't been filled out, despite asking for the MR the moment I received the letter and writing requesting in writing, both within 30 days.

Was told a week ago, it'll probably be another four weeks.

I have very little faith in them to be honest. It's an administrative appeal too regarding capital.
