I am cutting a very long story short here, my PIP award was suppressed - ended in May, I was on standard daily living and enhanced mobility.

I then called them in June to say I would be sending a written request for a mandatory reconsideration, but I was awaiting medical evidence anyway; they conducted a mandatory reconsideration without me knowing and the decision to end my award was upheld.

I appealed the decision in August and complained to my Local MP who wrote the DWP complain section, and they replied to him, a letter he forwarded to me, and said that they listened to my call.

I admitted I said I was going to send in a written request for an MR along with my medical evidence and made it clear I was not asking for one now; I was advising them I would be sending one.
However, they said it’s an automatic process, that’s stated from when I called.

They semi apologies for how they do but said they tried to contact me on the 6th and 7th of August.
So they will carry out a second MR, but I had already appealed by then, anyway yesterday, the DWP sent me a letter dated the 1st of September- which is the same date as their response to my local MP.

Responding to my appeal saying they can award me standard for daily living and mobility, and to call them within the next two weeks to accept and if I don’t my appeal will continue.

I want this all to end, but I am not happy with the drop in my mobility from enhanced to standard, as I need a lot of support from friends and family due to mainily my psychological health conditions to leave the house.

I wonder if I can ask them to change my mobility back to enhanced myself now, or to pay for a representative.
To be honest this whole process has been stressful, so part of me wants to just accept this offer, It does say in the letter I can appeal this decision later.

Yet I am unsure of what to do.…any advice from anyone who has dealt with this before?

Hi Jan89,

I had a similar situation to yours, but not with the award. I had been getting PIP for both standard daily living and standard mobility, and was requested in May to have a re-assessment via Telephone. I basically had my PIP stopped, so I put in for an MR, and got the same results saying that they had backed the HCP report, despite it being full of innaccuracies. I decided to go down the tribunal route at the courts ( afterall, none of my circumstances had changed, so I failed to see, how I could lose it ) - submitted all my evidence in July, but literally this week, before it got to the decision maker, I received a call from the DWP saying that they have re-reviewed my claim, and have changed their minds about the decision, and that my original award of standard for both daily living and mobility could continue, and it would be backdated. I accepted, as this is what I believed was the right outcome for me.

You've a couple of options really in my personal opinion:-

1/ accept the award in case it goes against you in the future.
2/ contest it, but see where you fell short on points via their assessors report ( you can request a copy of this ) and follow the guides on here to see if you can get your enhanced mobility.

Hope this information is of some help to you, but I'm sure some of the other mods or members of the forum will chip in with additional advice or suggestions that could be better suited to your needs.

You actually have three options.

1. Accept the offer and take no further action.
2. Reject the offer and continue on to appeal.
3. Accept the offer and lodge a new appeal for a higher award.

Thanks for the guidance, I already have the assessor report already from capita, and used the errors in it for my MR and appeal, I have also made a complaint to Capita, which I am yet to hear back from.

But this forum has been a great help to me in this process, especially seeing others story's etc, the whole system is very broken, causing many so much unnecessary stress.

It seems turning down awards is a tactic to make you give up, as I read in around 90% of appeals, PIP always make a offer before the appeal goes ahead.

Anyway thanks, guys, i did make a call earlier, to say to them to get someone to call me back to discuss their offer as it said in the letter i could do....so i will await for someone to call me back.
