ESA Review Confusion was created by Will - Lincolnshire'
I have been in the income-related ESA support group with the low tier disability premium since 2014. My last review was in 2017. I also get the standard rate PIP for both care and mobility. My last review in 2019 increased my award to 5 years so I expect to get the review form dropping on the mat in November.

I have always used a copy of my ESA50 form (on my PC) as a sort of dairy reviewing and updating it every few months. My rational being that I don't have to panic when the next one drops on the mat as I have a completed up to date form. I had transferred a lot of the information onto the UC50 form as well for the same reason. My other reason for doing this was my ESA and PIP reviews arrived with 10 days of each other in 2017. The stress was unbearable and it exacerbated my illness.

Yesterday I decided to look on the .gov.uk site to check if there was an updated or new ESA50 form. The form has been discontinued and new applications should be for UC. I learned that those in receipt of ESA will now be transferred onto UC in 2028 at the earliest, the year I get my private pension. It also states that in the meantime, those in receipt of ESA will only be transferred onto UC if they have a change of circumstance.

What worries me now is how those in receipt of ESA will reviewed prior to 2028. At my last review I had to complete the ESA50 but that is no longer the case.

Hi Philip B

I am not sure by what you mean when you say that you get the low tier disability premium.

ESA is an indefinite award with scheduled reassessment based on the Prognosis Date completed by the assessor in their report, so your existing ESA award continues in payment until a new Decision is made.

As you are in receipt of IR ESA, your occupational pension when you receive it will be taken into account £ for £.

ESA 50 form is the same as the UC 50 form apart from the name. Eventually those claimants on legacy IR ESA will be asked to apply for UC, for those claimants in rceipt of a SDP, they will be worse off claiming UC, for claimants in the support group but not claiming SDP, they will be better off, but we would advise any claimants to seek advice before applying for UC.

Apologies Gary. I mean the Enhanced Disability Premium.

Thanks for the information. Sorry if I did not make myself clear. When I first applied for IR ESA in 2014 I was placed in the support group without a Work Capability Assessment (WCA). I was told it was for 3 years when I made enquiries. They reassessed me 2017 where I had to complete another ESA50 followed by a WCA that I had to attend..

So when they decide to do a future scheduled assessment are you saying this could involve one of the following?.
  • telephone or in-person WCA without an ESA50 first as no longer exists
  • UC50 sent as ESA50 no longer exists so I would in effect be applying for UC without a change in circumstances

P

Forgive but I think you are confusing yourself with regard to the availability of the ESA50.

If you are still receiving Income Related ESA when next assessed then you will receive an ESA50, they still exist.

If you have been moved to UC then it will be a UC50.

As Gary has explained, there are only cosmetic differences between the two forms, the assessment criteria is exactly the same.
