I'm wondering if I could get some advice. My Partner has been severely unwell for a long time with both physical and mental illnesses. Few years ago he was awarded support group ESA with severe disability premium and PIP. Recently he had a PIP review and informed them his health has gotten worse as he's developed more physical disabilities. He got a copy of this assessment report and the report was full of lies and she had twisted things he said. As a result of this he's lost his PIP and also his ESA has changed to job seekers allowance. His ESA wasn't even due to review for another 4 years. Can they just change it to jobseekers without even reviewing? He plans to appeal but it very distressed because as a result of doing this, hardly any money has come into his account and so he cannot buy food or pay his bills
There is no mechanism to move a claimant from ESA to JSA. I suspect you saw JSA on a recent payment to your partner, if this is the case then it just means that the DWP made an ad hoc payment, the ESA payment system sits on top of the JSA.
The change to the ESA would likely be the removal of at least one SDP payment.
There is information in the PIP area that covers requesting an MR and then an appeal, if necessary.
