Pip review removed Mobility was created by Caval1er
So, I've just had my PIP assessment decision and they've removed standard mobility. They should not have done. I am awaiting the paper decision in the post, they told me over the phone because I insisted. I feel so awful about it. I know I have to wait for paper work and then ask for mandatory reconsideration. Should I do it in writing and then speak to decision maker after? I can't remember what I read on this before and my head is too mashed to search for it. I can't cope mentally with this but I have to fight it as it's not conceivable that they could make the decision that they have. Please could somebody explain the best way to approach this now? The dwp guy i spoke to on the phone did appear to be pushing me to lodge the mandatory reconsideration over the phone with him there and then??

Hi Caval1er
Have you asked for a copy of the assessment report? It's a PA4 if you had a telephone assessment. You need to know why they have removed your mobility award. It's hard to argue against it if you don't know the reason. You need to get hold of this as quickly as possible. We normally say it takes 7 - 10 days to arrive, but one member reported this week getting theirs the day after they asked for it. This should be your priority or you will be fighting blind and it's not easy to overturn a decision at the MR stage. You have one month to put in for your mandatory reconsideration from the date on the decision letter - so I hope it's on the way to you. The decision letter generally won't have the same level of detail as the report.
While you're waiting for the letters to arrive - go back to your form and look at our guides and see if there was anything you might have missed about your mobility or what you might need to strengthen. Not saying you did anything wrong, but when you're fighting to get something overturned you need to check to see if there is anything you might have missed.

Thank you for your reply. Yes, I received a copy of pa4 last week. I'm waiting for the decision letter any day now. I will do as you suggest and look through the guides. I don't think I missed anything. The assessor has documented the problems I told him, I have under the headings (on pa4 form)social and occupational history and also under functional history, but has not taken it into account when awarding me zero points for the activity....there's also evidence from my psychologist, therapists and gp where they answered the exact questions as in the form and it supports what I have told him. The only problem is the evidence is from 2019 and I'm not current getting any support so no supporting evidence that is more recent.

Hi Caval1er
It's challenging when you don't have recent evidence - but 2019 is not old. I've successfully got PIP for people with absolutely no recent evidence. The DWP should get real - the NHS does not keep people for years on end. There are limited resources and the pandemic has made it even harder to access mental health services. So many people have been discharged. It doesn't mean they have got better - they have simply been moved out for someone else to have a turn. And many resources have been cut. I recently had a conversation with a consultant psychiatrist who said that the whole service has changed in our area and they don't have support workers to help people or visit them, and they only want to see people who will get better in a timely fashion! I imagine it is the same in many other areas. So if you have the same problems that you did in 2019, slam it to them and argue that a person who has never met you and has no experience of your difficulties can't judge that your health has suddenly improved and contradict the evidence of the specialists who know you.

Thank you for your reply. One of the reasons for removing my mobility fr planning and making journeys was because as per the assessor my problems with making journeys appears to be linked to my social anxiety. Surely if I can't make journeys because of social anxiety and my mental health I should be awarded points? Or, does that question only apply to physical restrictions. From what I understand it seems the assesor doesn't understand that the question is applicable to mental health and physical restrictions?

Hi Caval1er
Your understanding of the question is correct and covered by mental health. A claimant should score if they have mental health difficulties that impact them undertaking a journey even before they leave the house. That includes being able to plan for the journey and whether they need support in the planning process or in getting out the door. It's quite possible a person may not have the support, which means they don't leave the house. This question has nothing to do with a person's ability to walk/move around and is covered in the following question.
