PIP Appeal Won! for Aspergers was created by triciatext
I have won my daughters Appeal despite not attending in person. She has been awarded enhanced daily living and mobility. I only appealed the mobility because she lost this when she transferred from DLA to PIP. but the tribunal looked at all her award and decided that she should be awarded enhanced for both elements. The DWP;s reason for not awarding her any points for mobility was that she could drive although she longer drives (she cant drive but does have a provisional licence) and she could budget because she buys on line. Both these reasons were completed at odds with even the ATOS medical report so goodness knows where they got this information from. They also ignored all the medical reports on how her condition affects her.
My daughter applied for PIP in March 2014! during this time her DLA run out and i lost my carers allowance.
The DWP have written to my daughter advising her of the revised PIP allowance and informing her that they will review this in two years even though her award is for three.
The DWP handling of her PIP is disgraceful but I didnt give up and used the Benefit and works guides to help me with her appeal.
The tribunal Clerk telephoned me on the day to let me know the outcome of her Appeal.
I encourage people not to give up if they are refused or do not get the level of award they believe to be fair.
Many many thanks for benefits and works without your help she may not have won her Appeal.

I have Asperger's and waiting on PIP claim. Do you mind if I ask, did your daughter have to attend a face to face assessment during her original claim?

That is amazing news! I had no idea that the Tribunal can seek to overturn a decision That a claimant has not disputed in favour of the claimant.
