I think it's probably true that any such mistakes will probably be rectified at tribunal (MR seems to be a waste of time in most cases but necessary to go through before progressing to tribunal) but that still leaves claimants distressed and possibly destitute for some time if HCPs are using the lack of CMHT treatment as an excuse to disallow claims, so hopefully this practice isn't widespread and your daughter was just unlucky with the HCP she got.
