Oops. Had some problems posting earlier so trying again.

The LT54 indicates the decision was given on the mobility descriptor Wa(ii) & the DM accepted Mr C could not repeatedly 50metres within a reasonable timescale due to ME/CFS symptoms. Clearly the activity diary we sent in carried some weight too. The DWP have said they will pay any arrears due for the time (28 September 2013 - 22Jan 2014). That's the good news.

The less welcome news is that he is due for review in October 2014 with full WCA by 'suitable' (my quotation marks) doctor. So come August time we will start all over again but we're will face the process better prepared thanks to the excellent advice on here.

I have two further queries please.

Will we be notified of the arrears or will it simply appear in the bank account?

And bearing in mind this decision was a revision & not as a result of appeal, will the time Mr C was in the WRAG be deducted from the allowed 365 days on CB ESA or will it be reset to zero?

Hope all the post arrives this time!!

Thanks

C

You should be notified of what arrears are due, but I would not be surprised if you see the payment before the notice, the DWP only use 2nd Class post :)

It does not matter that the updated award is the result of a Reconsideration, it still applies from the date of the original Decision, so if this was the Decision moving your husband from IB to ESA then the clock will be reset to zero and should a later Decision result in his being put in the WRAG again he will still have his 365 days of ESA(CB) payments.
